To be honest, I don't think they would put Earthworm Jim in Smash Bros. Mainly because the next Earthworm Jim game is supposed to be only on PSP, and from what I heard, Hideo Kojima begged the hell out of Shigeru Miyamoto  to put Solid Snake in the game, the thing that confuses me about it is that Shigeru and Hideo are supposed to already be close friends.. Plus SSBB is supposed to come out in a few months, so I'm sure it's already halfway through beta testing stages, either that or the game is already being produced and being ready to ship soon.

There's actually going to be a sport game of Sonic Vs Mario. You can reserve it now at EBGAMES/Gamestop
Because of that game Sonic may or may not appear in Smash Bros.

Sorry to tell you but, Jim's not getting in, there's a LOT of other characters more deserving than him let alone the fact more requested by people:

Megaman: Capcom's alliance with Nintendo, the exclusivity of RE0 and REMake. Megaman started on a Ninty console.

Pacman: Namco has done some games like Star Fox Assault, not to mention that Namco's part of the Triforce and Mario Kart GP.

Sonic: Requested as hell, everyone wants him, Sega's part of the Triforce too, SEGA pretty much did F-Zero GX also.

Secondary Possible Characters:

Capcom: Ryu and maybe a RE character like Leon or Jill because of REmake being a Ninty exclusive, the same with Gaiden, RE4 appearing first on the Cube and Leon being the first Main RE character to ever appear on a Nintendo console with RE2. That makes Leon's Score on Nintendo a 3 and maybe 4 counting Umbrella Chronicles, Jill has 3 counting Umbrella.

Namco: Raphael from SC, He seemed to have some rivalry with Link, may want to settle up things in Brawl.

SEGA: More characters from the Sonic World?

Konami: Soma from Castlevania, he has appeared in the recent games for the DS and GBA, so he may follow Ike's path of advertising even though those are a wee bit oldy but hey!

That's pretty much my thoughts. Megaman does have more of an alliance with Nintendo than any other 3rd party game. Reason is because of what Zero said, plus MMZX Advent, and Megaman Starforce for the ds.
Megaman Legends had appeared on N64 as Megaman 64. Then there was that game for Gamecube. Network Transmissions?

PAC-MAN?! WTF?! All he can do is eat and run! He'll never be in Brawl! He's just a morbidly obese circle-muncher! Earthworm Jim is ten times more deserving than him! He was IN a fighting game (3, to be exact!), And has more suitibility than RE or GTA people. Hell, the only OTHER people I want are Sonic and Rayman.

Jill will be able to use the Grenade Launcher as Snake's able to use a Rocket Launcher, Jill can also use the Tasser for comic relief. She can then borrow some moves from MVC2. Just because she comes from another M rated game it doesn't mean that she's gonna be a clone.

I believe that going by your logic, Mario's GOT to be a Clone of Kirby because you know they come from Platforming Adventure games o I forgot that Ness has to be a clone too because he looks like Mario! And Yoshi jumps on his enemies too!

You're almost insulting Nintendo with that, Nintendo has to be the one capable of giving ANYONE a Good Moveset, If they gave Mr. Game and Watch a moveset when he was only capable of...pretty much just catch oil, jump and walk they can give one to such a versatile character like Jill or Leon.

Oh and:

Peter > Homer.

Oh come on, MRGW's moveset was so obvious, he had so many games, all they had to do was give him an item from each game BAM... new char. Now Captain Falcon.... thats another story... C.Falc has no type of special powers whatsoever and I'm talking about the game series, not the anime. The fact that they were able to give him a whole entire moveset should tell you that any char could be in Brawl .
