I don't think so - it sounds like various members of the original team, if you believe their About page:
It's not the original team, or at least not all the members are from the original team (i.e. there are new members in this new 'Elecbyte' team). I'm going by the very statement that was made at Elecbyte's front page - someone new (i.e. not part of the original team) got rights to the Elecbyte name, mugen engine, and rights. The new 'admin' is a HUGE indication of that.

Anyways, hope this new team can bring mugen to new levels we've all dreamed and wished for.

which is pretty unambiguous.  Whether there are new members as well - quite possibly, but I don't see how that matters.

If the new team can attain the prestige of releasing a mugen for the new generation, more power to them and I will gladly throw my support to them like paper in the wind.

Alot of guys over at Xbox scene is looking to create a easier way to run mugen on xbox. If they have access to the source code maybe the xbox version can follow suit the the updates and become more compatible with characters.

I was just responding to the idea that some new, outside entity had acquired the "rights" to Mugen from the old team.  That doesn't seem to be the case - the current owners of the IP are (some of) the original creators.  The IP hasn't changed hands, is what I'm saying.

Not sure what you mean by this.  Doesn't much matter - I think we're agreed that Elecbyte appear to be back and on the job full time, which is good news indeed.

I honestly don't think that EOH will go anywhere near the new version till they release the full version of MUGEN 1.0 .... The RC1 that was just released is definitely something, but still needs a lot of work...

Well this is all great, but until they have full backwards compatibility I don't be using it. It's just an updated winmugen plus, only some characters and stages will no longer work.

why would we have to tell elecbyte that we're using their engine to make a game? wasn't the entire purpose of the original mugen engine to be an open source engine for creating fighting games? That's kinda like microsoft saying "look, if you use notepad to type a letter, let us know plz."

buem is proven it looks great but is a beta ... only a few drawbacks to correct esoero: 1280.720 Change the resolution does not change any other smaller let us stick ..?
  and the configuration of the buttons will not let me select qwaszx is azsxdc or two small flaws such horn orita meeting is a clear .. beta ..

But the thing is, this new mugen is laggy beyond playability for me. I mean, for others, it might be great, but if you have an older machine your screwed.

You can use it for free, absolutely, but if you want to distribute it then that's a different matter.  Not that they won't allow it, but the license clearly states they want to be consulted first.  Seems pretty reasonable to me.

When you write a letter, you send that letter - you don't send Notepad with it.  So it's not the same.

I might just do that...

But the thing is, this new mugen is laggy beyond playability for me. I mean, for others, it might be great, but if you have an older machine your screwed.
I think there are some bugs that are causing slowdown for some people - I don't think it's a case of your machine being too old.  It's probably some graphics driver issue; hopefully it's something that will be fixed in future versions.  My laptop is fairly puny but it runs the new Mugen lightning-fast.
